Manoj Kumar vs State of U.P.and another

Bharati Sapru, J.—Heard learned Counsel for the petitioner and the learned Standing Counsel for the State.

The applicant has stated in his application under section 24 C.P.C. that his appeal being appeal No. 19 of 2005 is pending before the Court of Commissioner, Agra Division, Agra. He is praying for transfer on the ground that in the month of July, 2008, he has received serious injuries in his back bone and is unable to travel.

In view of the facts and circumstances of the case, the appeal of the petitioner being appeal No. 19 of 2005 (Manoj Kumar v. State of U.P.) pending before the Court of Commissioner, Agra Division, Agra is transferred to the Court of competent jurisdiction in District Aligarh. The matter may be transmitted from Agra to Aligarh within a period of one month. Upon receipt of the record at District Aligarh, the matter may resume immediately. As from today, the Court of Commissioner, Agra Division, Agra will cease to proceed with the matter.

The writ petition is disposed of as above.
