Judgment
Learned counsel submits that in view of directions, 21 vehicles indicated in Table-1 and 2 vehicles indicated in Table-2 were challaned and action was
taken under Section 86 of the Motor Vehicles Act. In all, the 43 vehicles have been found to be violating conditions and an action has been taken.
While this court finds that action has been taken by the respondent/s, it is made clear that the order passed by the court is in the nature of continuous
direction and therefore, the Secretary & Commissioner of the Transport Department shall issue necessary directions for carrying out inspections at
regular intervals and see that unauthorised buses and vehicles with unauthorised registration numbers are not allowed to ply on any route and if found,
vehicles should be confiscated and action should be taken including imposition of heavy fine.
The Transport Department is additionally directed to conduct inspections of the buses and see whether buses are in fit condition to be plied as it is
noticed that many times while plying enroute the buses catch fire which may be due to the same being not in fit condition for plying on route, causing
loss of lives. Therefore, on routes from Jaipur to Gangangar as well as from Jaipur to Udaipur and similarly on other routes also, the Transport
Department shall conduct regular surprise inspection and take steps. The petitioners shall be free to again file a petition if they find that the regular
inspections are not being conducted and the orders are being flouted.
With the said observations, both the contempt petitions are disposed of. Notices stand discharged.
A copy of this order be made available to Mr. S.S. Raghav, AAG, who will apprise the concerned authorities of this order and also see that
compliance is made.
