Judgment
This petition is filed under Section 438 of the Code of Criminal Procedure.
The petitioners herein are the accused no.1 to 11 and 15, 16 and 17 in Crime No.692 of 2017 of Dharmadom Police Station for offences punishable under sections 341, 323, 324, 342, 354, 365 r/w Sec.34 of the IPC.
It is alleged by the prosecution that the accused who wanted to force the de facto complainant to withdraw from marrying a person belonging to another religion abducted the girl to one Yoga Centre and lodged her there. It is alleged that the remaining accused gave corporal punishment to her by beating with sticks and hands. There is a further allegation that some of the accused attempted to outrage her modesty. Complaint was lodged and crime was registered.
It is alleged that certain clandestine activities were going on in the Yoga Center allegedly run by the 1st accused herein. It seems that the petitioners 1 to 11 are also involved in other cases. The role played by the petitioners 10 to 14 appear to be minor. Hence, the petition is partly allowed. I am inclined to grant bail to the petitioners 10 to 14 who are accused nos. 10, 11, 15, 16 and 17 subject to the following conditions and the anticipatory bail application of the remaining petitioners stands dismissed.
(i) Petitioners 10 to 14 shall appear before the investigation officer within ten days from today and shall undergo interrogation. Thereafter, if they are proposed to be arrested, they shall be released on bail on each of them executing a bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two sureties for the like sum each.
(ii) They shall appear before the investigating officer as and when called for.
(iii) They shall not threaten, coerce or intimidate the defacto complainant or his witnesses.
(iv) They shall not get involved in any other identical offence. Anticipatory bail application is partly allowed as above.
