Judgment
Sujoy Paul, J.—With the consent of parties, matter is finally heard. Petitioner''s claim for compassionate appointment was rejected on the ground that he had four children and, therefore, as per M.P. Civil Services (General Conditions of Service) Rules, 1961, he is ineligible for consideration. Shri Roman relied on a GAD Circular dated 2.6.2012, wherein it is mentioned that the said provision will not be applicable in cases of compassionate appointment.
Considering the aforesaid, I deem it proper to dispose of this petition with the direction to the petitioner to file fresh representation along with GAD Circular dated 2.6.2012 and submit it before the respondents No. 2 and 3. In turn, the respondents No. 2 and 3 shall consider the said representation by taking into account the said GAD Circular and pass appropriate orders in accordance with law without getting influenced by their earlier order, Annexure P-1. The said consideration and decision will be taken within 90 days from the date of production of certified copy of this order.
It be noted that this Court has not expressed any opinion on the merits of the case. With the aforesaid, petition stands disposed of.
