Judgment

The petitioner/Sole Accused, who was arrested and remanded to judicial custody on 05.02.2024 for the offences punishable under Sections 341, 294(b), 324 and 506(ii) of IPC in Crime No.34 of 2024, on the file of the respondent police, seeks interim bail.
2.The case of the prosecution is that on 04.02.2024, due to previous enmity, the petitioner attacked the defacto complainant and abused him in filthy language. Hence, the case.
3.The learned counsel for the petitioner submitted that the petitioner did not commit any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit that the defacto complainant is a practicing Advocate in the local Court and hence, he is not able to file a bail application before the trial Court. Hence, he prays to grant interim bail to the petitioner.
4.The learned Additional Public Prosecutor appearing for the respondent would submit that it is a case and case in counter and the injured was already discharged from the hospital.
5.Considering the facts and circumstances of the case, this Court is inclined to grant Interim Bail to the petitioner. Accordingly, the petitioner/accused is hereby directed to be released on Interim Bail, on executing a own bond for a sum of Rs.10,000/-(Rupees Ten Thousand only), for a period of two weeks starting at 6.00 p.m. from 01.03.2024 till 5.00 p.m. on 15.03.2024 and the accused shall surrender before the respondent police at 5.00 p.m., on 15.03.2024 and he shall be produced before the trial court by the respondent Police on the same day. After coming out on interim bail, the petitioner/accused is directed to approach the regular Court for bail application.
