Judgment

By way of this petition, the petitioner has assailed the order dated 31.3.2021 passed in Cr.MP No. 39-4 of 2021 CNR No. HPBI010005702021 by
learned Additional Special Judge, Bilaspur, Himachal Pradesh (Camp at Bilaspur) for non-examination of certain witnesses.
I have heard learned counsel for the parties and gone through the record.
So far as the prayer of petitioner to examine Superintendent of Police and Dy. Superintendent of Police, Bilaspur are concerned, it is disallowed for
the reasons that what they can disclose can also be disclosed by their Reader or Clerk concerned. These two Officers are the lifeline of maintaining
the law and order of the district and should not be unnecessarily summoned in the Courts, as such the prayer is disallowed. So far as other witnesses
are concerned, the prayer is allowed.
Given above, petitioner is permitted to produce the following persons as witnesses:
(i) Reader/Clerk to the Superintendent of Police, Bilaspur;
(ii) Adda In- charge of HRTC, Bilaspur;
(iii) Sh. Ritesh Sharma, driver;
(iv) Subhash Chand, driver.
In view of above, the petition is allowed and the petitioner through his counsel is directed to appear before the learned trial court on 19.7.2021 and
produce these witnesses at his own and in failure to do so, the Court may issue summons to these witnesses. Pending miscellaneous applications, if
any, also stand disposed of.
