Petitioners seek quashing of cross FIRs No. 451/2017 of Police Station Keshav Puram, New Delhi for offence under Section 323/341/452/506/34 IPC and FIR No. 452/2017 of Police Station Keshav Puram, New Delhi for offence under Section 308/324/341/34 IPC.
The quashing is sought on the ground that parties have compromised the disputes with each other. Statements of parties were recorded by the concerned Joint Registrar.
Broadly speaking, on the issue of taking over Navyuvak Brahmin Samaj, two groups assaulted each other, causing multiple injuries to each other. In the alleged incident, one of them also lost consciousness and was taken to hospital. Both groups, in the incident threatened to kill each other.
Learned APP submits that State has no objection to these petitions keeping in mind permanent quietus as the petitioners are residents of same area.
I have examined both FIRs as well as MLCs of injured persons.
Considering the overall circumstances mentioned above, both these petitions are allowed and the cross FIRs No. 451/2017 of Police Station Keshav Puram, New Delhi for offence under Section 323/341/452/506/34 IPC and FIR No. 452/2017 of Police Station Keshav Puram, New Delhi for offence under Section 308/324/341/34 IPC and proceedings arising therefrom are quashed subject to each of the petitioners depositing costs of Rs. 10,000/- with DHCLSC within one week. It is made clear that if the cost is not deposited within one week, the proceedings arising out of these FIRs shall continue in accordance with law.
