Manmohan Singh And Ors vs State Of Rajasthan And Ors

These are two clubbed S.B. Criminal Misc. Petitions preferred respectively by petitioner/s Manmohan Singh and Sunil Kumar with a prayer to quash FIR No. 24/2015 registered with Police Station Nadbai District Bharatpur for the offence punishable under Sections 147, 148, 149, 332, 353, 336 and 307 of IPC.

Heard and perused the material available on the record. It has been contended by learned counsel for the petitioner that petitioner was an innocent counting agent of contesting candidate and he did not indulge in manhandling or any kind of misdeed, his name has falsely been implicated, investigating agency has not conducted the investigation fairly, so the petition deserves to be allowed and the FIR impugned be quashed.

On the contrary, learned Public Prosecutor has contended that petitioner is named in the FIR, he maltreated and created ruckus during the election and intermeddled with the process and assaulted police escort by firing, brick batting and thwarting the police party and election machinery involved, investigating agency has found his/their involvement established, there is no reason to quash the FIR and petition/s deserves to be dismissed.

FIR No. 24 dated 25.01.2015 reads as under :-

"एफ आई आर दर्ज करने बाबत। महोदय, निवेदन है कि आज दिनांक 24/1/2015 को मैं ASI राम सिंह पंचायत चुनाव वर्ष 2015 कानून व्यवस्था डयुटी में मोबाईल पार्टी नम्बर 16 का ईन्चार्ज ग्राम पंचायत डहरा पर तैनात हुं। इस पोलिंग पर डा. श्री गजेन्द्रसिंह चाहर जोनल मजिस्ट्रेट नम्बर 15 नियुक्त हैं। सरपंच पंच मतगणना समाप्ति के बाद श्री मानवेन्द्रसिंह को विजयी घोषित होने पर प्रमाण पत्र दिये जाने के बाद सभी उम्मीदवार व एजेन्टो को मतदान केन्द्र से बाहर किया ही जा रहा था तब ही समय करीब 10 च्ड पर हारे हुये प्रत्यासी सुनील पुत्र श्री जसमत जाति जाट निवासी डहराव बिश्वेन्द्रसिंह पुत्र मानसिह जाति जाट निवासी रैना ने अपने समर्थको जो मतदान केन्द्र के पास स्थिति भवनों की छतो पर व मतदान केन्द्र के गेट पर जमा थे को उकसा कर बुलन्द आवाज में कहा पोलिंग पार्टीयॉ ं मिल गई है। इतना सुनते ही उक्त दोनो उम्मीदवारों के समर्थकों ने फायरिंग व पथराव करते हुये मत पेटी छिनाने हेतु पोलिंग व पुलिस पार्टी पर जान लेवा हमता कर पोंलिग बूथ में घुसने की कोशिश की उपद्रवियों को मनASI व जोनल मजिस्ट्रेट नम्बर 15 डा. श्री गजेन्द्रिंसह चाहर तथा सुपरवीजन प्रभारी श्री महावीरसिंह थानाधिकारी पुलिस थाना मथुरागेट भरतपुर ने काफी समझाईस की एवं माईक से चेतावनी (मुनादी) दी गई परन्तु उपद्रवी नही माने व पोलिंग बूथ के सामने के भवनों की छतो से पुलिस पार्टी व पोलिंग पार्टियों को जान से मारने के इरादे से फायरिंग व पथराव करने लगे जिस पर आत्मरक्षार्थ बल प्रयोग करने व उपद्रवियों को तितर बितर करने हेतु लाठी पार्टी को अग्रेसर किया गया परन्तु पथराव अधिक होने के कारण लाठी पार्टी आगे नही बढ सकी जिस पर जोनल मजिस्ट्रेट नम्बर 15 ने पुलिस पार्टी को आत्मररक्षार्थ में आसू गैस छोडने के लिखित में आदेश दिये जिस पर शिवलाल कानि नम्बर 1279 ने गैस गन से तीन गैस सैल फायर किये परन्तु उपद्रवियों पर गैस को कोई प्रभाव नही हुआ तथा और अधिक उल्तेजित हो कर मारो मारो कहते हुये अत्याधिक पथराव शुरू कर दिया जिस पर जोनल मजिस्ट्रेट नम्बर 15 ने पुलिस पार्टी को गोली चलाने के लिखित में आदेश दिये जिस पर श्री महावीर सिंह पुलिस निरीक्षक थानाधिकारी थाना मथुरागेट ने 12 बोर पम्प एक्शन गन से 7 कारतूस हवाई फायर किये तथा श्री तुलाराम कानि. नम्बर 959 ने एस एल आर से 7 कारतूस व श्री सुरेशचन्द कानि नम्बर 988 ने एस एल आर से 10 कारतूस आत्मरक्षार्थ में हवाई फायर किये तब जाकर उपद्रवी तितर बितर हुये तथा पुलिस पार्टी व पोलिंग पाटी की जान बचाई जा सकी बिजली के उजाले में उपद्रवियों की पहचान की जो सुनील, सत्तो, देवो, अनिल उर्फ अन्नो, पुत्रान श्री जसमत, धर्मवीर उर्फ मिट्ठू, संजय पुत्रान भगवानसिंह, पप्पू पुत्र श्री उम्मेद, राजवीर पुत्र जीयालाल, पप्पू पुत्र श्री बलवीर, रवि पुत्र जगदीश, जीतेन्द्र पुत्र रामेश्वर, रूपेश पुत्र ताराचन्द, रन्धीर पुत्र समयसिंह, धुबीसिंह, बकील पुत्रान बाबूलाल, कपिल पुत्र गोविन्द, सुरेन्द्र, समन्दर पुत्रान मोतीराम, सरदार पुत्र सम्पत, सुरेन्द्र पुत्र श्री बदले, सत्यवीर बिज्जो पुत्रान श्री हरप्रसाद, राजेश पुत्र श्री फूलसिंह, साहबसिंह पुत्र श्री जबाहर, बीनू पुत्र श्री मोहन, सतीश पुत्र श्री रामकिशन, शेरसिंह पुत्र श्री परभाती, रिकदेब जातियान जाट निवासीगण डहरा थाना नंदबई तथा मोहन सिंह रिटार्यड पुलिस ए एस आई जाति जाट निवासी बरताई थाना कुम्हेर हाल रैना, मनमोहन पुत्र श्री सोहन सिंह, बिश्वेन्द्र पुत्र मानसिंह जाति जाट निवासी रैना तथा 100-150 आदमी गांव डहरा व रैना के थे। सूचना पर अतिरिक्त पुलिस जाप्ता मंगवाया गया तथा उपद्रवियों की तलाश की गई परन्तु रात्री व रिहायसी मकान होने के कारण उपद्रवी दस्तयाव नही हो सके। इस तरह उपद्रवियों द्वारा राज्य कार्य बाधित करते हुये पुलिस पार्टी व पोलिंग पार्टी को जान से मारने के ईरादे से फायरिंग व पथराव करना अपराध धारा 147, 148, 149, 332, 353, 336, 307 आई पी सी की तारीफ में आना पाया जाने पर पुलिस पार्टी द्वारा आत्मरक्षार्थ में चलाए गये गैस सैल खाली केश 3 को व 12 बोर पम्प एक्शन के 7 खाली केश व एस एल आर के 17 खाली केश को बास्ते बजह सबूत जप्त कर शील्ड मौहर किया जाकर क्रमश मार्क A, B, C, D दिया गया तथा मौके पर उपद्रवीयों द्वारा चलाये गये 2 खाली कारतूस 12 बोर पडे मिले जिन्हे पृथक से शील्ड मौहर कर मार्क D दिया गया बाद कार्यवाही तहरीर मय शील्ड पैकेट A, B, C, D बास्ते कायमी जुर्म सादर प्रेषित है। प्रार्थी रामसिंह ASI पुलिस थाना नंदबई हाल इचार्ज मोबाइ्रल पार्टी नम्बर 16 डहरा केम्प मतदान केन्द्र डहरा दिनांक 24-01-2015 समय 11:55 PM, SD रामसिंह ASI"

Perusal of the FIR discloses that petitioner Manmohan Singh S/o Sohan Singh and Sunil Kumar S/o Jasmat are named in the FIR alongwith several alleged rioters and FIR impugned has been lodged by Ram Singh, ASI of Police Station Nadbai, Incharge Mobile Party No.16, the said FIR and allegations have been thoroughly investigated by the investigating agency and a manifest report has been filed disclosing the outcome, suggestive that some of the accused persons have been apprehended and arrest of some of them is in offing and it has been found that involvement of Mohan Singh s/o Hari Singh, Manmohan s/o Sohan Singh, Dharamveer s/o Bhagwan Singh, Sanjay s/o Bhagwan Singh, Surendra s/o Moti Ram, Satish Kumar son of Ram Kishan, Sardar Singh s/o Sampat has been found proven, subsequent investigation has revealed involvement of Binu @ Vinesh Kumar s/o Mohan Singh, Darav Singh s/o Babu Lal, Devendra Kumar s/o Jaswant Singh, Satto @ Sunil Kumar s/o Jaswant Singh, Anil @ Anno s/o Jaswant, Satyaveer Singh s/o Har Prasad, Randhir Singh s/o Samay Singh, Pappu @ Chandra Prakash s/o Ummed Singh, Jitendra Singh s/o Rameshwar Dayal, Sahab Singh s/o Jawahar Singh, Rajveer Singh s/o Jia Lal, Pappu @ Mukesh s/o Balveer Singh, Vakeel s/o Babu Lal, Rupendra Singh s/o Tara Singh, Ravi @ Ravindra Singh s/o Jagdish Singh, Rajesh Kumar s/o Phool Singh has also been found, all have also stated to have been apprehended. Latest factual report no. 188 dated 10.01.2019 discloses that charge-sheet no. 344 dated 25.10.2018 for the offence punishable under Sections 147, 148, 149, 336, 353, 332, 307 of IPC has been filed against several accused persons including Satto @ Sunil Kumar son of Jaswant Singh, even a desi katta of .315 bore has been recovered from possession of one of the accused person under his instance made under Section 27 of the Evidence Act and the challan has already been filed before the court of jurisdictional magistrate.

Considering aforediscussed fact and circumstances, there appears no reason to interfere with the conclusion of the investigation, hence instant petition is/are dismissed, however the petitioner/s shall be free to agitate and raise all the grounds taken hereinunder before the concerned trial court at appropriate stage.
