Manmeet Malik and Another vs Labour Enforcement Officer (Central)

Kanwaljit Singh Ahluwalia, J.—Present petition has been filed u/s 482 Code of Criminal Procedure for quashing complaint No. 2132 of 2005 (Annexure P-1) filed by the Respondent - Labour Enforcement Officer (Central), Faridabad before the Judicial Magistrate First Class, Gurgaon and further proceedings arising therefrom.

This Court, on 30.5.2006 had exempted the personal appearance of Petitioner No. 2. On 4.9.2009, the present petition was admitted, however, it was ordered that the further proceedings shall continue.

Since this petition was instituted in the year 2006, by now, the trial may have concluded. Counsel for the Petitioner is not in a position to acquaint this Court regarding the status of the trial. The trial court is directed to conclude the proceedings within six months from the date of receipt of a certified copy of this order in case the same are yet to be concluded.

Personal appearance of Petitioners shall remain exempted till conclusion of the trial, however, trial court may secure presence, if so necessary.

Counsel for the Petitioners at this stage has submitted that the Petitioners are ready and willing to compound the offences. Petitioners, if so advised, may file application for composition and the same shall be decided by the trial court in accordance with the provisions of law, without insisting for presence of Petitioner No. 2.
