Manjit Singh Bedi - Appellant @HASH M/s L and T Finance Ltd. and Others

Amit Rawal, J. (Oral)—This order of mine shall dispose of two appeals bearing FAO No.3328 of 2014 titled as "Manjit Singh Bedi v. M/s Rs. & T Finance Ltd. and others" and FAO No.4635 of 2014 titled as "Jaswant Singh and another v. M/s Larsen & Toubro Finance Ltd. and other".

The Objecting Court had no jurisdiction as the Award was passed by the Arbitrator situated in Maharashtra, whereas the objections have been filed at Jalandhar. The objections could not have been filed at Jalandhar but before the Principal Court at Maharashtra, having the territorial jurisdiction.

Keeping in view the aforementioned facts and circumstances, objections were not maintainable before the Objecting Court and therefore, there is no substance in both the appeals.

However, the liberty is granted to the appellant(s) to file objections seeking condonation of delay as per the provisions of Section 14 of the Limitation Act in a competent Court provided they file the same within a period of one month from the date of receipt of the certified copy of this order.

Interim order granted by this Court shall be remain in force and thereafter, they shall be at liberty to seek the interim injunction in a competent Court having the territorial jurisdiction.

With the aforesaid observations, the appeals stand disposed of.
