Manjit Singh vs Director of Technical Education and Training, Punjab and others

G.R. Majithia, J.—This revision petition is directed against the order of Additional District Judge, Ludhiana, whereby he dismissed the application filed u/s 5 of the Limitation Act, for condoning the delay in the appeal which was apparently filed beyond limitation.

The learned appellate Judge was not satisfied with the explanation furnished by the petitioner for not presenting the appeal within limitation. The petitioner filed an affidavit before the learned first appellate Court stating therein that he was unwell from July 12, 1988 to August 11, 1988 and during this period he was advised rest by the doctor attending on him. In the certificate issued by the doctor attending on the petitioner it is stated that the petitioner was suffering from some eye trouble. The learned appellate Judge found that the petitioner failed to establish sufficient cause for not presenting the appeal within limitation. The conclusion arrived at by the leaned appellate Judge calls for no inference in revisions.

I do not find any illegality or irregularity in the order passed by the learned appellate Judge. The revision petition is dismissed.
