This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

This is the 2nd successive bail application U/S.483 of the BNSS by the petitioner for grant of bail in connection with Panikoili P.S. Case No. 07 of 2025 corresponding to S.T. Case No.34 of 2025 pending in the file of learned Addl. Sessions Judge, Jajpur for commission of offences punishable U/Ss.109/310(3)/ 61(2)(a) of BNS r/w. Sec. 25/27 of the Arms Act, on the main allegation of committing dacoity with murder and murder of one innocent passerby.

Heard, Mr. Soura Chandra Mohapatra, learned Senior Counsel, who is being assisted by Mr. S. Mohapatra, learned counsel for the petitioner and Mr. P. Satpathy, learned Addl. PP in the matter and perused the record.

After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for not only committing dacoity in the jewellery shop of the informant, but also committing murder of one person thereon, so also committing murder of an innocent passerby and that apart, the petitioner has been allegedly identified in TI parade. Besides, there is recovery of some gold ornaments along with arms and ammunitions from the present petitioner. In that view of the matter and taking into consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the materials placed on record, this Court is not inclined to grant bail to the petitioner.

Hence the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the Court in seisin over the matter for reference.
