Manjit Kaur vs Satpal Joshi and others

Mahesh Grover, J.—The petitioner alleges violation of the orders of this Court dated 2.2.2012 and 2.4.2012. Earlier this Court had passed directions to give the keys of the house in question to the petitioner. He allege that the same were given but subsequently taken back and then a Criminal Misc. was filed in which further directions were given to the Police Commissioner, Amritsar to retain the keys of the house till the time the parties to the dispute get the question of possession settled before the Court of competent jurisdiction. It is not clear as to how the petitioner is aggrieved considering the fact that the order of this Court are clear enough giving liberty to the parties to establish their possession before the Court of competent jurisdiction. Learned counsel for the petitioner contends that she is in possession of some portion of the house and, therefore, the entire house could not have been locked in the process. I am not in agreement with the contention raised by the learned counsel for the petitioner for the reason that the question of possession is yet to be determined by the Court of competent jurisdiction and at this stage to accept what the petitioner says and that too without any material on record would only prejudice the case of the parties.

Petition dismissed.
