Judgment
Rajiv Narain Raina, J
When the matter came up for hearing on 17.09.2019, this Court passed the following order on the statement of the petitioner that the application presented by the petitioner was not accepted till such time his mother applied, the fate of which is not known.
"Contends that the petitioner has completed 5 years of sentence for entitlement of parole. The application presented by the prisoner was not accepted till such time his mother applied for on 26.08.2019 on advice of the counsel requesting parole for four weeks for house repair. The stage of the application is not known and 21 days have expired.
Mr. Saurabh Mohunta, DAG Haryana to look into the status of the application and report on the next date of hearing. Copy of the petition be supplied to Mr. Mohunta, DAG Haryana during the course of the day.
List on 20.09.2019."
In the reply filed by the Superintendent, District Jail, Kurukshetra filed in Court today by Mr. Mohunta, in response it is averred that as per record no application has been received in the office neither by the petitioner nor by the family member regarding grant of parole to the petitioner. Statement of the petitioner has been falsified. No relief will come to the petitioner based on the false statement. No other consideration will outweigh this falsity.
Accordingly, the petition is dismissed.
However, dismissal of the petition should not be a bar for presentation of another parole application, which if presented, will be decided in accordance with law and within the time frame of the Haryana Government instructions issued by the Director General of Prison.
