SUDIP AHLUWALIA J. (ORAL)
This is a petition for regular bail under Section 439 Cr.P.C. on behalf of the petitioner, who was arrested on 01.06.2017 in case FIR No.142 dated
29.04.2017, under Sections 307, 325, 394 and 397 of the IPC and Sections 25/54/59 of the Arms Act registered at Police Station Sadar, District Jind.
[2]. It transpires that co-accused Anil was granted bail by the Ld. Additional Sessions Judge, Jind vide the order dated 05.01.2018 (Annexure P-5).
The involvement of the present petitioner in the occurrence as seen from the statement of the victim Ajay Singh (Annexure P-2) appears to be of
similar nature inasmuch as gun shots were fired by the various accused persons including the co-accused Anil at the victim.
[3]. Considering the long detention undergone by the petitioner by now, and on the principle of parity with the remaining accused persons, who have
been granted bail by the Ld. Court below in all the similar circumstances, he is also ordered to be released on regular bail subject to appropriate terms
and conditions to the satisfaction of the Ld. Trial Court/Duty Magistrate, concerned.
