Judgment

Apprehending danger to their lives, petitioners, who are legally wedded husband and wife, have filed instant petition under Art. 226 of the Constitution of India, praying therein for issuance of a direction to the respondents to provide them adequate security/police protection.
Notice.
Mr. B.C. Verma, learned Additional Advocate General accepts notice on behalf of the respondents. He fairly states that in view of prayer made in the petition, no formal reply is required to be filed by the respondents and, as and when a request is made to Police Station concerned by the petitioners for providing police protection, same shall be provided to them.
Facts of case, as emerge from record are, that the petitioners, who are major and belong to same caste, have solemnized marriage of their own volition, but since parents of petitioner No.1 are not happy with the marriage, they are extending threats to the petitioners and are further compelling petitioner No.1 to leave company of petitioner No.2. Material placed on record with the petition clearly reveals that the petitioners, who are major, have solemnized marriage and, as of today, they are living as legally wedded husband-wife.
Though petitioners, who hail from Paonta Sahib, District Sirmaur, are residing in Paonta Sahib, but since parents of petitioner No.1 also reside at Paonta Sahib, there is every likelihood of harm being caused to them by the parents of petitioner No.1, as such, prayer has been made in the instant petition for providing police protection to them, which deserves to be allowed.
Accordingly, the present petition is disposed reserving liberty to the petitioners to file a representation to Superintendent of Police Sirmaur at Nahan, within two days from today, who shall decide the same expeditiously, and provide adequate police protection, if any, forthwith. Needles to say, authority concerned, while doing needful in terms of this order, shall also call upon the parents of the petitioners, so that they are advised and counseled not to indulge in any illegal activities, failing which they shall render themselves liable for penal consequence and contempt of court.
The petition stands disposed of in the afore terms, alongwith all pending applications.
