PER RENU JAUHRI:
This appeal filed by the assessee against the order of the Commissioner Income Tax (Appeal) /NFAC [for short, Ld. CIT(A)] dated 26.06.2024, passed u/s 250 of the Income Tax Act, 1961 [for short, Act]. The assessment was framed by Assessing Officer [for short, Ld. AO] u/s 143(3) r.w.s 144B of the Act.
The assessee has raised following revised grounds of appeal:
“A. BECAUSE the Ld. AO erred in law and fact by adding Rs.3,09,03,270/- under Section 68 as unexplained cash credits, without bringing any adverse material evidence on record. The Ld. CIT(A), while partly allowing the Appeal, mechanically upheld 22,98,71,225/- of the said addition, failing to appreciate the comprehensive documentary evidence furnished by the Appellant, which clearly discharged the initial burden of proving the identity, creditworthiness, and genuineness of the transactions. The addition has been sustained based purely on conjecture and surmise, contrary to the law.
B. BECAUSE no adverse material has been brought on record in respect of any of the lenders namely, Mr. Amanjeet Singh Khurana, Late Sh. Avtar Singh Khurana, Greenfinch Team Management Pvt. Ltd., Mrs. Pooja Kulshrestha, and Surya Team Management Pvt. Ltd. either by the Ld. Assessing Officer or by the Ld. CIT(A), who failed to appreciate or rebut the relevant documentary evidence duly furnished by the Appellant, unequivocally discharging its burden u/s 68 of the Act by establishing identity, creditworthiness, and genuineness of the unsecured loans totalling ₹2,81,40,894/-, all without any cogent evidence, substantive inquiry, or rebuttal, treating the loans as non-genuine solely on presumptive and inconsequential observations, depicting clear non-application of mind.
Therefore, the Ld. CIT(A) erred both in law and on facts in upholding the addition of ₹2,81,40,894/- under Section 68, rendering the impugned order illegal, arbitrary, and liable to be set aside.
C. BECAUSE appellant had duly furnished all requisite documents before both the Ld. Assessing Officer and the Ld. CIT(A), including confirmation letters, bank statements, ITRs (for relevant assessment years), computations of income, ledgers, and audited balance sheets (where applicable), all of which were admitted on record and never rejected. These documents unequivocally establish:
•Identity of each creditor;
•Creditworthiness, supported by ITRs, banking transactions, and financial statements;
•Genuineness of the transactions, as all loans were routed through account payee banking channels, with substantial portions (over 70-80% in most cases) repaid in the same year.
Therefore, appellant has thereby discharged its initial burden under Section 68 of the Income Tax Act, 1961. The Ld. CIT(A) failed to shift the onus to the revenue authorities for further inquiry under Sections 131 or 133(6), and instead relied on minor discrepancies such as ITRs for adjacent assessment years, bank statement periods, low returned incomes, absence of reserves/surplus in balance sheets, or the lender's advanced age/death none of which constitute adverse material warranting addition.
Without prejudice to the above, the Appellant now submits additional evidence including the ITR for A.Y. 2018-19, the relevant page of the bank statement showing the advance loan entry of Rs. 5,00,000/-from Mr. Amanjeet Singh Khurana, the bank statement of Late Shri Avtar Singh Khurana showing receipts of Rs. 5,00,000/- from Bharat Facilities, and the bank statement of Mrs. Pooja Kulshrestha for the period 01.04.2017 to 31.03.2018 for the kind consideration of this Hon'ble Bench. These documents further substantiate the creditworthiness of the lenders.
D. BECAUSE the Impugned Order is perverse, arbitrary, illegal, and unreasonable, as it fails to consider the material evidence on record, resulting in a miscarriage of justice. The Ld. CIT(A) exhibited non-application of mind by upholding the addition of Rs. 2,98,71,225/- under Section 68 without adequate basis while relevant documentary evidence was duly furnished by the Appellant, unequivocally discharging its burden;
The above grounds of appeal are without prejudice to one another. The appellant craves the right to add, amend, alter, withdraw or forgo any ground or grounds of appeal before or at the time of hearing with the leave of this Hon'ble Tribunal.”
Although the assessee has raised multiple grounds of appeal, sole substantive issued involved is relating to addition of Rs. 2,98,71,225/- u/s 68 on account of unexplained cash credits, confirmed by the Ld. CIT(A).
Brief facts of the case are that the assessee filed his return for A.Y. 2018-19 on 15.10.2018 declaring income of Rs. 34,14,610/-. The assessee has shown business income from 2 proprietary concerns M/s Bharat Facilities and M/s EVA Facilities which are engaged in supply of manpower services. The case was selected for limited scrutiny on the issue of default in TDS and unsecured loans. Assessment was completed vide order u/s 143(3) r.w.s. 144B dated 21.04.2021 assessing the total income at Rs. 4,16,85,730/- after making the following additions:
Addition u/s 68 : Rs. 3,09,07,219/-
Disallowance u/s 40(a)(i): Rs. 73,67,852/-
Aggrieved, the assessee preferred an appeal before the Ld. CIT(A). Vide order dated 26.06.2024, appeal was partly allowed by the Ld. CIT(A) whereby he deleted the disallowance u/s 40(a)(i) and reduced the addition u/s 68 to Rs. 2,98,71,225/-.
Further aggrieved, the assessee is in appeal before the Tribunal.
Before us, Ld. AR has submitted that the assessment proceedings were conducted during the Covid-19 Pandemic period and the order was passed on 21.04.2021 at the peak of pandemic. The assessee could not submit reply to the show-cause notice dated 17.04.2021 as there was complete lockdown and therefore, an application for adjournment was filed on 21.04.2021 which was not considered. However, requisite confirmations and other details were already furnished before the Ld. AO as under:
| Sl. No. | Name of the lender | Relationship | Purpose of loan | Evidence furnished |
| a. | EVA Facilities | Own Proprietorship Concern | Business Loan | |
| b. | Amanjeet Singh Khurana | Relative | Family Loan | Confirmation ITR and Computation of the Income for AY 2017-18 |
| c. | Avtar Singh Khurana | Relative | Family Loan | Confirmation Copy of ledger account |
| d. | Kay Verma Construction | Friends Company | Family Loan | Copy of Ledger account Copy of ITR for the AY 2016-17 and 2018-19 |
| e. | Greenfinch Team Management Pvt. Ltd. | Director | Business Loan | Confirmation balance sheet as on 31.03.2018 for A.Y. 2017-18 AND 2018-19 |
| f. | Pooja Kulshreshtha | Friend | Business Loan | Confirmation ITR for AY 2016-17 to 2018-19 Copy of the ledger account |
| g. | Surya Team Management Pvt. Ltd. | Friend is director in the company | Business Loan | Confirmation Balance Sheet as on 31.03.2018 ITR for AY 2016-17 to 2018-19 |
Hence, in the light of above, the onus of the assessee to establish the identity and creditworthiness of the parties as well as genuineness of the transactions was adequately discharged. Further, additional documents were filed before the Ld. CIT(A) on which remand report was sought from Ld. AO. As no remand report was submitted by the Ld. AO, the additional evidences were admitted by the Ld. CIT(A) and the partial relief was allowed by accepting the genuineness of the following loans:
M/s EVA Facilities : Rs. 8,32,045/-
Kay Verma Construction: Rs. 2,00,000/-
In respect of the remaining 5 loans, Ld. CIT(A) has given his findings that the creditworthiness of the lenders and genuineness of the transactions was not established. It has been further argued by the Ld. AR that all the loans were taken for business purposes and in some cases these were partly repaid during the year. Moreover, assessee has been taking loans from some of these parties in earlier years also as per its business requirement which also proves the genuineness of these transactions. Following chart has been submitted in support of these contentions:
S. Name of the lender Opening Received Repayment Outstanding No. balance during the loan as on year 31.03.2018

He has further submitted that Ld. AO had not made any further verification u/s 133(6) or brought any material on record to show that any of the impugned loans was non-genuine. In the light of above, Ld. AR has vehemently argued that since requisite details were furnished before the Ld. CIT(A), the onus of the assessee stands fully discharged.
On the other hand, Ld. DR has strongly relied on the orders of the lower authorities. He has pointed out that wherever requisite details were furnished, Ld. CIT(A) has accepted the genuineness in respect of those loan amounts. However, the assessee has not been able to establish the creditworthiness of the remaining 5 lenders and the genuineness of transactions due to which Ld. CIT(A) has rightly upheld the addition u/s 68 of the Act.
We have heard the rival submissions and perused the material placed on record. We note that the assessee has not furnished complete requisite information to the satisfaction of the Ld. AO and even before the Ld. CIT(A), the details submitted were not complete in respect of the following 5 entities.
| Sl. No. | Name of the Lender | Outstanding loan as on 31.03.2018 (in Rs.) |
|---|---|---|
| 1 | Amanjeet Singh Khurana PAN: BIDPK1484Q Address:1534, Sector-15, Faridabad-121007 Haryana | 18,10,000 |
| 2 | Avtar Singh Khurana Address: 1534, Sector-15, Faridabad-121007, Haryana | 3,99,971 |

Accordingly, in the interest of justice, we deem it appropriate to restore the matter to Ld. AO in respect of verification of the 5 loans as above. The assessee is directed to furnish the requisite documentary evidences before the Ld. AO to enable a decision on merits.
In the result, the appeal of the assessee is allowed for statistical purposes.
