This is a revision against the judgment and order dated 28. 02.2020, whereby the learned appellate Court has confirmed the conviction and sentence of one year under section 325 of the IPC recorded by Judicial Magistrate First Class, Tarana District Ujjain vide judgment dated 14.09.2018.

Now both the parties have compromised the case. IA No.5551/2020 is filed for granting permission to compromise and IA No.4588/2020 is filed for compromise.

The compromise is verified by the Principal Registrar of this Court. As per report of the Principal Registrar, both the parties are competent to compound the case in all respect and have compromised the case voluntarily, without any fear, pressure, coercion, threat or undue influence from either side. The offence found proved against the petitioner is compoundable.

Considering the compromise between the parties, the judgment and order dated 28.02.2020 passed by the learned appellate Court in Criminal Appeal No.342/2018, so also the judgment and order of the learned trial Court dated 14.09.2018 passed in Criminal Case No.675/2013 are set aside. Petitioner - Mangilal is acquitted from the charge under Section 325 of the IPC. Fine amount, if deposited, be returned to the petitioner.

Bail bond stands discharged.

With the aforesaid, the present petition stands allowed and disposed off.
