Judgment
This application is preferred to review the order dated
27.07.2016, whereby a Division Bench of this court accepted the
appeal preferred by the State of Rajasthan giving challenge to the
judgment dated 1.05.2015 passed by learned Single Bench. In the
case aforesaid after examining merits the court concluded that as
per the Government of Rajasthan Circular dated 25.01.1992, the
petitioner, a class IV employee, is entitled to have selection grade
pertaining to the first promotional post i.e. of Jamadar and not of
Lower Division Clerk.
It is submitted by learned counsel appearing on behalf of
review petitioner that the respondents should have considered
case of the petitioner for grant of promotion as well as selection
grade pertaining to the post of Lower Division Clerk as an avenue
for promotion to that post is also available in addition to the post
of Jamadar.
We are of considered opinion that the issue now sought to be
agitated by way of this review petition pertains to merits of the
case which were adequately considered by this Court, as such, no
ground exist to review the order. The review application, hence, is
dismissed.
