Shri Mangi Lal, the petitioner, is present in person before this Court.

By way of filing of the instant miscellaneous petition, challenge has been made to the order dated 20.11.2018 passed by the learned Special Judge, NDPS Act Cases, Jodhpur in Criminal Misc. Case No.42/2018 pertaining to FIR No. 99/2017 registered at Police Station Dangiawas, District Jodhpur whereby the prayer made by the petitioner for releasing the vehicle in question (Talor Tata LPS) bearing registration No. RJ-19-GC-2989 has been declined.

The petitioner Mangilal submits that he is a special power of attorney holder of the vehicle which has been seized by the Police Officers. He further submits that he is the person best entitled to get back the possession of the seized property.

Learned Public Prosecutor opposed the criminal revision petition.

Heard learned counsel for both the parties. The petitioner, Shri Mangi Lal, claims to be a special power of attorney holder of the registered owner of the vehicle, Shri Dinesh Kumar, who is an accused of the case lodged in connection with contravention of Penal Provisions of NDPS Act. The vehicle came to be seized by the police way back on 27.10.2017 and from nowhere it is reflecting that when the power of attorney was given to the petitioner Mangi Lal or where it is existing or is in currency till date. Otherwise also, in view of the stringent provision contained under the NDPS Act, at this stage, I am not inclined to allow the instant criminal revision petition.

Accordingly, the instant revision petition is dismissed.
