Heard Mr. B.S. Negi, learned counsel for the petitioners, Mr. Vikas Pande, learned Brief Holder for the State and perused the record.

According to Mr. B.S. Negi, petitioners were employees of Basic Education Board, who were appointed in different years between 1969 to 2004. While serving under Basic Education Board, petitioners were not enjoying status of Government servant. Subsequently, status of Government servant was conferred upon the petitioners in terms of Section 58 of Uttarakhand School Education Act, 2006. Their grievance is that their past services, rendered in Basic Education Board, are not being taken into account for grant of benefit under Assured Career Progression Scheme.

Learned counsel for the petitioners submits that the controversy involved in the present writ petition is covered by the judgment rendered by co-ordinate Bench of this Court in WPSS No. 1534 of 2015. Learned counsel for the petitioners further submits that the said judgment is based on a decision of the Division Bench of this Court rendered in Special Appeal No. 44 of 2010.

Mr. Vikas Pande, learned Brief Holder for the State does not dispute that the controversy stands concluded by the aforesaid judgment relied upon by the petitioners.

Accordingly, the writ petitions stand disposed of in terms of the judgment dated 08.01.2016 passed by the co- ordinate Bench of this Court in WPSS No. 1534 of 2015.
