Judgment
Heard learned counsel for the applicant on audio-call and learned Public Prosecutor on WhatsApp Video call and perused the case file.
The accused-petitioner was arrested in connection with FIR No.77/2020, registered at Police Station Kesrisinghpur, District Sri Ganganagar, for offence punishable under sec.8/15 of the NDPS Act. The accused-petitioner has filed this Bail Application under sec.439 CrPC.
In this matter, recovery of the contraband Poppy Husk from possession of the accused is 03 kilograms 200 grams, which is less than the commercial quantity.
In the facts and circumstances of the matter, without commenting on merits of the case, this Court deems it appropriate to enlarge the accused-petitioner on bail under sec.439 CrPC.
Accordingly, this bail application is allowed and it is ordered that the accused-petitioner Manga Singh s/o Tej Singh arrested in connection with FIR No.77/2020, Police Station Kesrisinghpur, District Sri Ganganagar may be enlarged on bail provided he furnishes personal bail bond of Rs.50,000/- with one surety in the like amount, to the satisfaction of learned trial court concerned.
