Judgment
15.01.2025: I.A. No. 180 of 2025: By this application, the Applicant has prayed for following reliefs:
“(a) Direct the Ld. Registrar of this Hon'ble Tribunal to take steps to keep / transfer the amount of Rs.309,11,29,558.37, deposited by the appellant/ applicant (detailed table in para 3 herein), as interest bearing fixed deposit;
(b) pass such other consequential directions so to ensure that the directions pursuant to prayer (a) above are implemented in true letter and spirit;
(c) pass such other and further order(s) as this Hon'ble Appellate Tribunal may deem fit in the facts and circumstances of the present case.”
Letter dated 13.01.2025 issued by Deputy Registrar, NCLAT has been placed before us which indicate that the amounts have been deposited through different Challans in the Government Account maintained at Punjab National Bank in which no interest component is available. Total amount deposited is Rs.309,11,29,558/-.
Learned counsel for the Respondent has no objection if amount is kept in an interest bearing account.
In view of the above, we direct that said amount be remitted to the Registrar, NCLAT, who shall create a fixed deposit to earn interest on the aforesaid amount.
With aforesaid direction application is disposed of
