Heard learned counsel for the petitioner, learned Standing Counsel for the opposite party No.1 and Sri Rakesh Kumar, learned counsel for the opposite party No.2.
The instant writ petition has been filed by the petitioner against an interlocutory order by which the opposite party No.1 has granted interim relief to the opposite party No.2 in the appeal preferred by him against the order of the Arbitrator dated 27.11.2008.
The learned counsel for the parties have informed the Court that 21.05.2009 is the date fixed before the opposite party No.1 for final hearing of the appeal. A joint prayer has been made that this writ petition may be finally disposed of with a direction to the opposite party No.1 to decide the aforesaid appeal on the next date fixed. Learned counsel for the parties have given an undertaking that they will not seek any adjournment.
In view of the aforesaid and keeping in view the joint request of the parties, it is directed that the opposite party No.1 shall consider and decide the Appeal No.26 of 2009 on the next date fixed i.e. 21.05.2009. In case for some reasons, the opposite party No.1 is unable to decide the appeal on 21.05.2009, he shall make every possible endeavour to decide the same within a further period of ten days.
Learned counsel for the parties shall file certified copy of this order before the opposite party No.1 within a week from today.
Subject to the aforesaid, the writ petition stands finally disposed of.
