Judgment
TEJINDER SINGH DHINDSA, J.(ORAL).
The instant petition was preferred under Section 438 Cr.P.C. seeking concession of anticipatory bail to the petitioner in case FIR No.249, dated
08.08.2017, under Sections 323/324/427/458/506/148/149 IPC, registration Sadar Nakodar, Tehsil Nakodar, District Jalandhar Rural.
The instant petition came up for preliminary hearing on 11.10.2017 and while issuing notice of motion, interim protection was granted subject to the
petitioner joining investigation. Thereafter, matter stood adjourned to 09.02.2018.
On 09.02.2018, learned State counsel had apprised the Court that the petitioner had not joined investigation. Accordingly, matter was deferred to
today and petitioner was directed to appear before the Investigating Officer and to join investigation on 28.03.2018 at 10 A.M.
Learned State counsel upon instructions from HC Balwinder Singh informs the Court that the petitioner has chosen not to join investigation.
Counsel representing the petitioner would seek to justify the conduct of the petitioner by submitting that he stands convicted in another criminal
proceedings under the NDPS Act and it is on account of such circumstances that he did not join investigation.
However, the details of conviction in the other matter are not forthcoming.
Conduct of the petitioner dis-entitles him from the concession of pre-arrest bail.
Dismissed.
