Judgment

This writ petition has been filed by the petitioner-institution being aggrieved with the judgment dated 08.07.2022 passed by the Medical and Health Department, Government of Rajasthan, Jaipur, whereby the appeal filed by the petitioner-institution under Section 30 of the Rajasthan Para Medical Council Act, 2008 has been dismissed.
The petitioner-institution preferred the said appeal against the order dated 05.05.2022 passed by the Rajasthan Para Medical Council, Jaipur, whereby the application filed by the petitioner-institution for establishing the Para Medical Collage was rejected on the ground that the petitioner-institution has failed to deposit the requisite fees and documents for its inspection.
Learned counsel for the petitioner-institution has submitted that as a matter of fact, the petitioner-institution had sought information from the Para Medical Council regarding the requisite fees and documents but the same was not provided to it, therefore, it was failed to furnish the requisite fees as well as the documents.
Learned counsel for the petitioner-institution has submitted that as the petitioner-institution is now in the knowledge of the requisite fees as well as the documents, which are to be submitted before the Rajasthan Para Medical Council, one last opportunity be granted to it to file fresh application along with the requisite fees and the documents before the Rajasthan Para Medical Council for the purpose of its inspection.
Learned AAG has no objection if the petitioner-institution be granted liberty to file fresh application along with requisite fees as well as the documents.
In such circumstances, this writ petition is disposed of with a direction to the petitioner-institution to move a fresh application along with the requisite fees and the documents before the Rajasthan Para Medical Council within a period of 15 days from today. If the Rajasthan Para Medical Council finds the application filed by the petitioner-institution is complete in all respect, the inspection of the petitioner-institution be carried out within a period of one month thereafter and pass appropriate order in accordance with law.
Stay petition also stands disposed of.
