Judgment
Heard Mr. Amonkar, learned Counsel for the petitioners.
Learned Counsel for the petitioners submits that the petitioners are the Managing Committee Members of Shree Ravloba Devasthan at Velus and that, in a Petition filed by Lakso Budgo Gurav and 4 others i.e. Writ Petition No. 2471/2021 (F), the petitioners herein, have not been impleaded, as party respondents, though the structure in question, which is sought to be demolished, belongs to the petitioner-Devasthan. Learned Counsel for the petitioners submits that there is a possibility of the temple i.e. structure no. 3, being demolished by the Valpoi Municipal Council, pursuant to the demolition order dated 08.01.2020. According to the learned Counsel, the respondent no. 3 has not conducted any enquiry as to whom the said structure belongs to and has passed an order of demolition, on the basis of a complaint filed by respondent no. 5 to respondent no. 9.
Issue notice to the respondents, returnable on 05.01.2022. In addition to Court's notice, private service is permitted.
Mr. Arolkar, learned Additional Government Advocate waives notice on behalf of respondent nos. 1 and 2.
The Petition filed by Lakso Budgo Gurav and 4 others i.e. Writ Petition No. 2471/2021 (F) is due on 05.01.2022. The present Petition also be listed with the aforesaid Petition i.e. with Writ Petition No. 2471/2021 (F).
In the meantime, the demolition of structure no. 3, the photographs of which are at Exhibit E-colly at pages 69 and 70 is stayed.
Stand over to 05.01.2022.
