Judgment
THIS appeal is directed against the order passed by the District Forum, Trichur in O.P. No. 316/ 1997. The opposite party is the appellant.
WE heard the Counsel for the appellant. Though notice was issued to the complainant/ first opposite party and it is served, the complainant has not appeared. The only contention taken is that the subscription voucher with Consumer No. 3737 is issued to some other person. However the opposite parties have not proved this by producing documents to show that subscription voucher was issued to some other person Exbts. Al to A5 would show clearly that the LPG refils were supplied to the complainant and even a second refil was also considered and intimation was given by the first opposite party saying that application got matured. In the circumstances we do not find any ground to interfere with the direction given by the District Forum to continue to supply cylinders. However, in this case we are unable to sustain the order granting compensation to the complainant. The complainant has also failed to produce the subscription voucher. We also vacate the direction made by the District Forum that the second opposite party should consider whether or not the 1st opposite party should continue as an agency. However this will not preclude the second opposite party from taking any action independently of this direction, if it has come to its notice any regularities committed by the first opposite party. The appeal is disposed of as above. Appeal disposed of.
