Judgment
Yashwant Varma, J—The applicant has been charged in Case Crime No. 811 of 2014 under sections 420, 406, 467, 468 and 471 I.P.C. Police Station Kotwali, District Bareilly.
Learned Counsel for the applicant has submitted that the actions complained of do not constitute cheating. He has referred to the registered agreement dated 23.1.2010 executed between the parties to submit that the right of forfeiture was correctly exercised and thereafter a fresh contract was entered into on 6.2.2014. He has further submitted that the applicant has no criminal history.
Learned AGA has opposed the bail application.
However, considering the facts of the present case, this Court is of the opinion that the applicant is entitled to bail.
Accordingly, let the applicant-Man Singh involved in Case Crime No. 811 of 2014 under sections 420, 406, 467, 468 and 471 I.P.C. Police Station Kotwali. District Bareilly, be enlarged on bail on his executing a personal bond and furnishing two sureties, each in the like amount to the satisfaction of the Court concerned subject to the following conditions that:--
The applicant shall not tamper with the prosecution evidence, nor intimidate/pressurize the witnesses, during the investigation or trial.
He will cooperate in the trial bonafidely without seeking adjournments.
He shall not indulge in any criminal activity or commission of any crime after being released on bail.
In case of breach of any of the above conditions, it shall be a ground for cancellation of bail. Identity, status and residence proof of the applicant and sureties be verified by the Court concerned before the bonds are accepted.
