Heard Mr. B.P. Pradhan, learned counsel for the appellant.
The appellant has filed this writ appeal challenging the order dated 23.08.2023 passed in W.P.(C) No. 21451 of 2022 under Annexure-3, by which the learned Single Judge has set aside the order of appointment of the appellant passed by the Addl. District Magistrate, Puri and directed respondent no.5 to conduct a selection and complete it within a period of three months by publishing the fresh advertisement.
Mr. B.P. Pradhan, learned counsel for the appellant vehemently contended that even though appellant was opposite party no.6 in the writ petition, her appointment order has not been challenged by the respondent nor she has been given opportunity of hearing in the writ petition. As such, without giving opportunity of hearing and without assigning reason, the appointment of the appellant has been set aside. Therefore, the petitioner has approached this Court by filing the present writ appeal.
Issue notice to the respondents.
Since Mr. L.N. Rayatsingh, learned counsel has already entered appearance for respondent no.1, let copy of the appeal memo be served on him by tomorrow (19.12.2023) enabling him to obtain instructions or file counter affidavit.
Five extra copies of the writ appeal be served on learned State Counsel appearing for respondent nos.2 to 6 by tomorrow (19.12.2023) enabling him to obtain instructions or file counter affidavit.
As an interim measure, it is directed that any steps taken pursuant to advertisement dated 25.10.2023 under Annexure-4 shall abide by the result of the writ appeal.
