Judgment
Augustine George Masih, J.—Counsel for Respondent No. 5 has produced a crossed demand draft No. 166054 dated 20.05.2011 drawn at The Sangrur Central Co-op. Bank Ltd. amounting to Rs. 2,78,662/- which has been handed over to the counsel for the Petitioner. The total amount of gratuity, which the Petitioner was entitled to, has been received by the Petitioner.
In the reply filed by Respondents No. 1 to 4 in para 2 of the preliminary submissions, it has been stated that the legal heirs of the deceased Darbara Singh can put forth the claim for employment on compassionate grounds but the same can only be granted if the conditions, as imposed in letter No. CA-5/1242 dated 05.10.1994 issued by the Registrar, Cooperative Society, Punjab, Chandigarh, are fulfilled.
In case, the legal heirs of Darbara Singh makes such a claim within a period of one month, the same shall be considered and decided in accordance with the above-mentioned letter within a period of six months from submission of such representation.
Counsel for the Petitioner prays that since the Petitioner was entitled to the amount of gratuity on the death of her husband, which was in the year 2006, the Petitioner shall file a representation for her claim for interest and a direction be issued to the Respondents to consider the same within a period of four months from the date of the submission of said representation.
The claim of the Petitioner for interest will be considered by the Respondents within a period of four months'' from the date of the submission of said representation which if filed by the Petitioner. The decision taken thereon be conveyed to the Petitioner forthwith.
Writ petition stands disposed of accordingly.
