Judgment
Mr. V. Narsingh, learned counsel appearing for the Opposite Party Nos.2 and 3 (Ashwini Hospital) informs this Court that the Petitioner is presently being treated under the Biju Swasthya Kalyan Yojana ('BSKY') scheme and the sum of Rs. 30,000 collected from him shall be refunded to the Petitioner by Opposite Parties 2 and 3 not later than 12th November, 2021. As regards the other sums he may have spent, it will be refunded to him by Opposite Parties 2 and 3 within a week as per the BSKY scheme subject to the sanction/approval being received from the State Government. The said statement is placed on record.
Mr. D.K. Mohanty, learned Additional Government Advocate states that if a time bound direction is issued, it will be complied with. Accordingly this Court directs the Government to accord its approval not later than 22nd November, 2021 for the treatment of the Petitioner under BSKY scheme and inform the hospital accordingly.
Mr. V. Narsingh, learned counsel for the Opposite Parties No.2 and 3 pointed out that the post of Swasthya Mitra who is to act as a coordinator between the hospital and the Government, has been vacant since 16th October, 2021. It is accordingly directed that the Health and Family Department will forthwith to appoint a Swasthya Mitra for the Ashwini hospital without any delay.
The writ petition is disposed of in the above terms.
