This petition is filed seeking quashment of FIR in Crime No.108 of 2023 registered against the petitioner on the file of the first respondent Police, for the offence punishable under Sections 341, 294(b) and 506(2) IPC and Section 4 of Tamil Nadu.mhc.tn.Prohibitiongov.in/judis of Harassment of Women Act, 2002.
2.Mr.E.Antony Sahaya Prabahar, learned Additional Public Prosecutor has taken notice for the 1st respondent.
The petitioner and the defacto complainant have stated to have amicably resolved the disputes amongst themselves.
Considering the submissions made above, the Officer in-charge of the High Court Legal Services Committee is directed to verify the identity of the defacto complainant and the accused with the aid of Aadhar card or any other recognised identity cards and also ensure that the latest photograph of the defacto complainant and the accused are affixed on the memo of compromise. Further, the first respondent police are also directed to be present and identified the defacto complainant and accused. After establishing identity, the Officer in-charge is directed to inquire, informally, as to whether there is any force or coercement on either of the parties compelling them to compromise and send the report by 28.09.2023.
The parties are directed to appear before the Officer in-charge, High Court Legal Services Committee on 22.09.2023 and for filing the report, list on 29.09.2023.
