M.M. Aggarwal, J.—This is petition for quashing of FIR No. 97 dated 20.8.1997 Annexure P-1 as against the present Petitioner registered at Police Station, Rampura District Bathinda for offence u/s 7 of E.C. Act read with Clause 19(i)(a) of the Fertilizers Control Order and all subsequent proceedings arising therefrom.

Earlier Diwan Chand, Chief Manager (Production) and one Iqbal Singh, Area Manager, Indian Farmers Fertilizers Co-op. Ltd. had filed petitions for quashing of FIR which had been accepted by this Court vide Annexures P-3 and P-4 on the ground that it had not been averred in those petitions that Petitioners of those petitions were in-charge and responsible for over all conduct of the business of the company and for maintaining the quality of the fertilizers. Present Petitioner is stated to be just a Secretary. His case is not different than those of the Petitioners against whom FIR had already been quashed. Under these circumstances, this petition is allowed. FIR No. 97 dated 20.8.1997 (Annexure P-1) as against the present Petitioner registered at Police Station Rampura District Bathinda for offence u/s 7 of E.C. Act read with Clause 19(i)(a) of the Fertilizers Control Order and all subsequent proceedings arising therefrom are quashed.
