Judgment
A detailed order was passed by us on 15.03.2022 and finally in Para 7, the following directions were issued :
"7. In view of the above consideration, we direct the following:
(a) The CR covering period 01.11.2019 to 16.07.2020 be expunged.
(b) The applicant be considered afresh by the No.5 SB based on the revised profile.
(c) The release of the applicant ordered vide MS Branch letter No.05544/SSC-93(NT)/MS 7B dated 06.12.2021 be held in abeyance, till fresh consideration by the No.5 SB and promulgation of results."
Today, Shri Rajeev Kumar, Advocate along with Brig S. Prabhu, Brig MS Legal appeared for the respondents. On instructions, we are informed that in pursuance of the order passed on the last date i.e. 15.03.2022, CR of the applicant for the period from 01.11.2019 to 16.07.2020 has been expunged, the applicant's case has been placed for consideration afresh, in the changed circumstances, before the No. 5 Selection Board and it would be considered by the Board as and when the Board meets. Further, the release of the applicant ordered on 06.12.2021 has been kept in abeyance till further decision is taken on the basis of the recommendation that may be made by the No. 5 Selection Board.
Keeping in view the aforesaid, we find that all the prayers made by the applicant in this OA having been fulfilled, nothing survives for the present and accordingly, the OA stands disposed of.
