Judgment

Heard Mr. Ajoy Pebam, learned counsel for the petitioner.
The petitioner is a bidder along with 4 others who are respondent Nos. 5, 6, 7 & 8 in NIT dated 27-11-2025 issued by the Public Health Engineering Department, Government of Manipur for providing and laying of raw water main to Andro town. In the tender summary report (Annexure A/9 in the writ petition), the technical bid of the petitioner was rejected and those of respondent Nos. 5 to 8 are admitted for financial bid. The proceeding is challenged on the ground that the rejection of the technical bid of the petitioner is not disclosed and the private respondents have not filed undertaking in terms of clause 8 (ii) of the NIT.
Issue notice.
Mrs. Ch. Sundari, learned Government Advocate, accepts notice on behalf of respondent Nos. 1, 2, 3 & 4.
The petitioner is directed to take steps to respondent Nos. 5, 6, 7 & 8 by speed post within one week and file an affidavit of proof of service.
Mr. Ajoy Pebam, learned counsel for the petitioner, prays for stay of further process of the NIT as well as the award of contract.
Mrs. Ch. Sundari, learned Government Advocate for the State respondents, has opposed the prayer for interim relief and prays that she may be given some time to take instructions.
However, Mr. Ajoy Pebam, learned counsel for the petitioner, submits that anything done in the NIT shall be subject to the outcome of the writ petition.
This Court has observed that any proceeding under the NIT shall be subject to the outcome of the writ petition.
