This Criminal Appeal has been filed under section 341 of Cr.P.C. against the impugned order dated 15.04.2021 passed by the learned 2nd Addl.

Sessions Judge , Puri in Crl. Misc. Case No.06 of 2020 in holding the petitioner guilty of filing false affidavit and directing the learned S.D.J.M., Puri to

take cognizance of the matter after accepting the petition of the respondent no.2 Deba @ Debendra Kumar Sahoo and to proceed against the

appellant.

Perused the impugned order and the averments taken in the appeal memo.

Issue notice to respondent no.2 on the question of admission indicating therein that the matter will be disposed of at the stage of admission.

Learned counsel for the State submits that he has received the copy of the appeal memo.

Let an extra copy of the appeal memo be served on the learned counsel fo the State which will be sent to the Inspector-in-charge of Talabania police

station for its service on respondent No.2.

List this matter in the week commencing from 9th August 2021.

Heard learned counsel for the appellant and learned counsel for the State.

There shall be stay of operation of the impugned order dated 15.04.2021 passed by the learned 2nd  Addl. Sessions Judge, Puri in Crl. Misc. Case

No.6 of 2020 till the next date.
