Judgment
D.G. Deshpande, J.—Heard Mr. Lotlikar, the learned Senior Counsel for the applicants and Mr. C.A. Fereira, the learned Public Prosecutor for the State. The P.P. has filed replies in all the applications. The replies are taken on record and kept in the respective files. The Police Inspector of the Cuncolim Police Station is present. Looking into the allegations made against the applicants and after hearing the learned P.P. and going through the replies, this is a fit case where the anticipatory bail is required to be granted.
All the applications are allowed. In case the Cuncolim Police decides to arrest any of these applicants in Crime No. 35/07 on the complaint of Diwakar Dessai, they shall be released on personal bond of Rs. 5,000/-each. The applicants will give co-operation to the police in investigation and they will attend the concerned police station as and when called for and will not, in any manner, contact the witnesses or influence them or the complainant
The applicants shall produce the black colour Alto car No.9599 and red colour Alto No.8559 and a Maruti car No.3855 (numbers of the vehicles are as given in the reply filed by the P.P.) for inspection of the police and there will be no attachment of these vehicles. All the criminal misc. applications are disposed of. Copy of the order of the learned Sessions Court is given by the learned P.P. and taken on record. Copies of this order, duly authenticated, be issued to the parties.
