Judgment

I.A. No.04 of 2026 is an application filed by the Appellant under Section 151 of the Code of Civil Procedure, 1908, seeking extension of three years time to vacate the premises from where he has been evicted vide the Judgment of this Court in RFA No.03 of 2024, dated 06-11-2025.
The very submission of Learned Counsel for the Appellant is obnoxious and audacious with scant respect to the directions of this Court and it seeks to denigrate the findings and directions of this Court. The plea is completely unacceptable and is rejected outright.
In such circumstances, the Appellant is directed to vacate the premises in terms of the Judgment of this Court dated 06-11-2025, by 23rd April, 2026, without fail. Should he fail to comply necessary consequences shall follow.
He shall also pay costs of ₹ 50,000/- (Rupees fifty thousand) only, within two weeks, to the Sikkim State Legal Services Authority for use in Child Care Institutions.
I.A. No.04 of 2026 stands disposed of accordingly.
