This application has been filed for modification of the judgment and order dated 3rd November, 2008 by which the writ petition was disposed of with a direction to the Deputy Inspector General of Police, U.P. Lucknow to examine the matter and pass an appropriate order on the representation dated 9th July, 2008 filed by the petitioner expeditiously.

In the affidavit filed in support of the modification application, it has been stated that even though the petitioner has brought the judgment and order dated 3rd November, 2008 to the notice of the Deputy Inspector General of Police, U.P., Lucknow on 24th November, 2008 and 27th December, 2008 but decision has not been taken as the Court has not fixed any specific time for deciding the representation. Learned counsel for the petitioner submits that the order should be modified by fixing a time limit.

Learned Standing Counsel appearing for the respondents states that the Court had directed the Deputy Inspector General of Police, U.P. Lucknow to decide the representation expeditiously and, therefore, the said representation should have been decided by now but in case it has not been decided, the Deputy Inspector General of Police, U.P. Lucknow shall now decide the said representation within a period of six weeks from the date a certified copy of this order is produced by the petitioner.

In view of the submission made by the learned Standing Counsel, this application is disposed of with a direction to the Deputy Inspector General of Police, U.P. Lucknow to ensure compliance of the judgment and order dated 3rd November, 2008 within a period of six weeks from the date of this order.

Copy of the order shall be supplied to Sri Amit Kumar, learned Standing Counsel by Monday i.e. 13th April, 2009 for communication to the Deputy Inspector General of Police, U.P. Lucknow.
