Judgment
Dr.Nupur Bhati, J
The interlocutory application (No.01/2021) filed by the applicants’ counsel under Order 1 Rule 10 CPC, is allowed for the reasons mentioned therein.
Amended cause title filed by the newly added parties, is taken on record.
Learned counsel for the newly added respondents submits that in light of the order dated 20.11.2021 passed by the Coordinate Bench of this Court by which effect and operation of the order dated 10.11.2021 (Annexure-17) and the order dated 11.11.2021 (Annexure-18) passed by the Additional Registrar, Cooperative Societies, Bikaner Division, Bikaner Appointing Administrator was stayed and the petitioner continued to hold the post of Chairman. Learned counsel for the newly added respondents submits that as per Section 27 (4) of the Cooperative Societies Act, 2001, the term of office of the elected members of the committee and its office bearers shall be five years from the date of election and in the present case, the petitioner-Chairman assumed the charge on 28.05.2018 and thus, his term of five years has come to an end and therefore, the writ petition has become infructuous.
In view of the submissions made and looking to the fact that on account of interim order dated 20.12.2021, the petitioner-Chairman continued on his post and the said term of five years has come to an end, the instant writ petition is accordingly disposed of and the interim order granted by this Court is made absolute.
Stay application as well as all other pending applications, if any, also stand disposed of accordingly.
