Heard on IA No.19643/2023. This is an application 389(1) of Cr.P.C for suspension of sentence and grant of bail.
The appellants have been convicted under Sections 323 of IPC and sentenced to undergo simple imprisonment of 3-3 months and a fine of Rs.500-500/- with default imprisonment.
It is submitted by counsel for the appellants that their sentence has already been suspended by the trial Court for a period of one month and they have been directed to obtain a stay order.
Considering the submissions that the sentence awarded to the appellants has already been suspended by the trial Court, I.A. No.19643/2023 is allowed. On furnishing a personal bond in the sum of Rs.50,000/- (Rupees Fifty thousand only)each along with one surety each in the like amount to the satisfaction of the Trial Court, it is directed that the remaining jail sentence of the appellants shall remain suspended and they shall be released on bail. The appellants are permanently exempted from appearing before the Registry of this Court. However, they shall appear as an when directed.
