Judgment
Manoj Kumar Tiwari, J
Heard learned counsel for the parties through video conferencing.
By means of this writ petition, petitioner has sought the following relief:-
“1) A writ order or direction in the nature of mandamus directing the respondents for done the inquiry and taken the legal action for the such ration
dillar.â€
Learned counsel for the petitioner submits that the fair price shop dealers in Landhaur, Roorkee, District Haridwar are committing irregularity,
however, the authorities are not taking any action against them despite complaints.
Without expressing any opinion on the merits of the case, this Court thinks that ends of justice would be met, if petitioner is permitted to make
representation to the concerned Supply Inspector, who shall look into the matter and take appropriate decision, in accordance with law.
Accordingly, the writ petition is disposed of with liberty to petitioner to make representation to the concerned Supply Inspector within ten days from
today. If such representation is made within stipulated time, the Supply Inspector shall look into the matter and take appropriate decision, in
accordance with law, within a period of six weeks from the date of receipt of representation alongwith certified copy of this order.
It goes without saying that, before taking any decision, the concerned fair price shop dealers shall be given reasonable opportunity of hearing.
