Judgment
Manoj Kumar Tiwari, J
Since common questions of law and fact are involved in these writ petitions, therefore are being taken up together and are being decided by this common judgment. However, for the sake of brevity, facts of WPMS No. 2045 of 2015 are being considered.
By means of this writ petition, petitioners have sought the following reliefs:-
"I. Issue a writ, rule, order or direction in the nature of writ of mandamus commanding and directing the respondent no. 1 & 2 to take necessary action regarding non implementation of forged settlement/compromise deed dated 4-6-2015 (Annexure no. 1) alleged to be occurred between the Management RMI Steels and RMI Steels Ltd. Workers Union which is null & void being not duly signed by all union members.
II. Issue a writ, rule, order or direction in the nature of writ of mandamus commanding and directing the respondents to take necessary decision regarding payment of the dues of the workers with immediate effect."
Mr. B.S. Koranga, learned counsel appearing for the petitioners submits that he is not pressing the reliefs, as claimed in the writ petition, and he submits that the writ petitions may be disposed of with a direction to learned Labour Court, Haldwani, District Nainital to expedite hearing of Adjudication Case No. 03 of 2011.
The prayer made is innocuous, therefore is worth accepting.
Accordingly, Writ Petitions are disposed of with a request to learned Labour Court, Haldwani, District Nainital to make every endeavour to hear and decide Adjudication Case No. 03 of 2011 at the earliest; but, not later than nine months from the date of production of certified copy of this order.
