Judgment
Prakash Tatia, J.—Heard learned Counsel for the parties.
The petitioner was suspended by order dated 18.11.2002 and the petitioner has challenged the suspension order on the ground of prolonged suspension running since last more than six years and further submits that though the case was registered under the provisions of Prevention of Corruption Act against the petitioner but even in almost seven years, no challan has been filed against the petitioner. The petitioner submits that in identical facts and circumstances, this Court in the cases of (1) Shaukat Ali v. State of Raj. WLR 1992 (S) Raj. 855, (2) Prem Prakash Mathur v. State of Raj. and Ors. 2005 (9) RDD 3962 (Raj.), Vishnu Kr. Gupta and Anr. v. State and Ors. 2009 WLC (Raj.) UC 701 and (4) Jai Prakash Soni v. State of Raj. and Ors. SB Civil Writ Petition No. 6492/06 decided on 17.12.2007), had quashed the suspension order.
In view of the above, since the petitioner was suspended as back as on 18.11.2002 and seven years have passed and yet the challan has not been filed against the petitioner, therefore, the order of suspension of the petitioner dated 18.11.2002 is quashed and set aside.
The writ petition of the petitioner is allowed accordingly.
