Judgment

Grievance of the petitioner/society is that petitioner/society has preferred appeal under Section 40 of M.P. Societies Registrikaran Adhiniyam, 1973 before Registrar, Firms and Societies, Bhopal on 12.4.2024 assailing the order passed by Assistant Registrar, Gwalior on 1.4.2024 whereby directions were issued to conduct election within a period of 60 days between founder members of society. As per petitioner, there is no single founder member available in the society as either they have resigned or died. The society preferred appeal but till now the appeal has not been decided whereas period fixed by Assistant Registrar will expire on 30.5.2024.
Counsel for petitioner submits that if direction is issued to the Registrar, Firms and Societies Bhopal to decide the appeal at the earliest, the petitioner will be satisfied.
Government Advocate appearing on behalf of respondents/State has no objection if such direction is issued.
Considering the fact that appeal has already been filed on 12.4.2024, the present petition is disposed of with a direction to the Registrar, Firms and Societies, Bhopal to decide the appeal within a period of one month from the date of receipt of certified copy of this order in accordance with law after affording opportunity of hearing to all the parties.
Till decision of the appeal, the effect and operation of the order dated 1.4.2024 passed by Assistant Registrar, Firms and Societies, Gwalior shall remain stayed.
It is made clear that this Court has not expressed any opinion on the merits of the case.
With the aforesaid, present petition is disposed of.
