Judgment
IA. No. 121 of 2024: By this Application, Applicant has prayed for following interim prayers:
“(a) pass an order to stay all proceedings and further proceedings before the National Company Law Tribunal, in respect of the Impugned order dated 28.04.2023 passed by the National Company Law Tribunal, Mumbai, Court-I in C.P.(IB)/1315(MB)2017, pending final disposal of the present Appeal.
(b) pass an Order staying the proceedings in IA (I.B.C) No.3985/2023 in C.P.(IB)/1315(MB)2017 filed by the Respondent No.2 before the Hon’ble NCLT, Mumbai Bench-I, pending hearing and final disposal of the present Appeal.
(c) pending hearing and final disposal of the present Appeal, no steps shall be taken by the Respondent No.1 and 2 and to maintain status quo; and
(d) pass such order or further order/s as this Hon’ble Appellate Tribunal may deem fit and proper ion the facts and circumstances of the case.”
We are of the view that no directions as prayed in the application could be passed as on date. However, we observe that any action taken in pursuance of the impugned order shall abide by the result of the Appeal.
