Learned counsel for both sides submit on respective instructions that the matter has been settled on terms that (i) the amount deposited by the appellants with the State Commission in compliance of this Commission’s Order dated 27.08.2019 along with interest if any accrued thereon may be released by the State Commission to the respondents and (ii) the statutory amount of Rs. 35,000/- deposited by the appellants with this Commission at the time of filing of the appeal may be released by this Commission to the respondents.

Learned counsel for the appellants also submits that this settlement has been agreed to by the appellants only because the amount involved is not very huge and because it wants to put a period to the lis. He however requests that it may be made explicit that the issues involved are being kept open and this case will not be treated as a precedent.

In the wake of the above submissions the present appeal is disposed of with the direction that the amount deposited by the appellants with the State Commission in compliance of this Commission’s Order dated 27.08.2019 along with interest if any accrued thereon shall be released by the State Commission to the respondents and the statutory amount of Rs. 35,000/- deposited by the appellants with this Commission at the time of filing the appeal shall be released by this Commission to the respondents.

This Order has been made on consent. As such the decision in this case shall not be treated as a precedent. The issues involved are kept open.

The Registry is requested to send a copy each of this Order to the parties in the appeal and to their learned counsel within three days. The stenographer is requested to upload this Order on the website of this Commission immediately.
