The petitioners, by means of instant writ petition, have challenged the advertisement issued by Uttarakhand Public Service Commission dated 23.07.2024 for selection to the post of Lecturer in Polytechnic in different fields. The ground of challenge is that the impugned advertisement stipulated for the eligibility qualification which is contrary to AICTE notification.

It appears that the advertisement was issued in accordance with the existing rules framed by the State Government for selection and appointment in technical institutions in the State.

During pendency of the writ petition, the State Government, by Office-Order dated 27.03.2026, has amended the offending provisions and now the same have been brought in line with AICTE guidelines.

The stand of the respondent in this regard was noted by us in our order passed yesterday, which is as follows:-

“1.

Mr. Abhijay Negi, learned counsel for the petitioners.

2.

Mr. B.S.Parihar, learned Additional C.S.C. for the State.

3.

Mr. Yogesh Kumar Pacholia, learned counsel for the respondent no.2.

4.

Mr. Niranjan Bhatt, learned counsel for the interveners.

5.

Mr. Pankaj Miglani, learned counsel for the Uttarakhand Public Service Commission.

Mr. Pankaj Miglani, learned counsel for the Commission states that the State Government has already amended the rules and has included post graduation degree also in the eligibility qualification. Accordingly, the grievance of the petitioners stands redressed.

7.

Learned counsel for the petitioner seeks time to complete his instructions on the said aspect.

As prayed, put up tomorrow.”

On matter being taken up today, learned counsel for the petitioners Mr. Abhijay Negi very fairly concedes that the grievance of the petitioners stand redressed, as a result of the amendment made in the rules.

Mr. Pankaj Miglani, learned counsel for the Uttarakhand Public Service Commission states that now advertisement for selection on the post in question would be issued as per the amended rules.

7.

In view of the above, nothing further survives for consideration in the present matter.

8.

Accordingly, the present writ petition stands disposed of as having become infructuous.

9.

Pending application(s), if any, stand disposed of accordingly.
