Judgment
Virendra Saran, J.
Heard learned counsel for the applicant and the learned State Counsel.
The applicant is involved in Case Crime No.10/2001 under Section 302 IPC and a chargesheet has been filed on 432001 before the learned Chief Judicial Magistrate, Kheri. The learned trial Judge has also issued nonbailable warrant and process under Sections 82 and 83 Cr.P.C. against the applicant.
Learned counsel for the applicant has submitted that the applicant has no intention of absconding and she is ready to appear in Court.
Considering the submission of learned counsel for the applicant it is directed that the execution of nonbailable warrant and the process issued under Section 83 against the applicant shall remain stayed for a period of three weeks from today. If during this period the applicant appears and makes any application to the concerned Magistrate, he shall recall the warrant and the process issued by him under Sections 82 and 83 Cr. P.C. and learned Magistrate shall thereafter proceed in accordance with law.
It is further provided that in case the applicant makes any application for her bail application shall be disposed of by the Courts below as expeditiously as possible keeping in view the fact that the applicant is a woman.
With the above directions, observations this application is finally disposed of.
